MEMPHIS, Tenn. — A former Memphis police officer, who was acquitted on rape charges Wednesday, could get out of jail as early as Thursday.

Wednesday, a jury found John Smith not guilty of rape.

Smith was found guilty of official oppression.

He was given the maximum two year sentence on the oppression charge.

Because he’s spent the last several years in jail awaiting trial, he could be granted freedom today.

His trial was delayed several times due to an attempt to fire his attorney as well as mental evaluations.

Smith was accused of raping  a woman while on duty in 2009.
