BARTLETT, Tenn. — The Tennessee Bureau of Investigation is in Bartlett following a barricade situation that turned deadly.

It happened Tuesday night at a home in the 5300 block of Stage Road.

Toby Bailey, 38, was pronounced dead at the scene around 1:30 a.m. Wednesday after SWAT teams stormed the home and shot him.

TBI said Bailey had raised a weapon toward officers when they entered the house and deployed tear gas. A Rottweiller inside the house was also shot and killed.

The subject’s family said Bailey had a janitorial business and recently lost a contract. He was depressed and drinking, the uncle said, and so the wife called police

In a release obtained by WREG, the TBI said Bartlett officers were initially called to the scene before 9:45 p.m. for a domestic violence incident.  When they finally arrived, Bailey “ran inside the home, made threats to shoot the officers, and barricaded himself.”

When WREG arrived several minutes later officers were overheard on a megaphone saying “put the weapon down and pick up the phone.” Several of the individual’s family members then pleaded with the subject to come out of the house and surrender to police.

“I tried to talk him out of the home. I told him to put the weapon down and come on out, but he wasn’t coming out. He wasn’t responding,” Kenwick Porter said.

Over the next few hours, Bailey fired several shots inside the home, the TBI said.

At 1:30 a.m., our crew said they heard multiple loud bangs — which the TBI attributed to tear gas — and then the SWAT team entered the home. Several seconds later there was a series of muffled bangs.

The TBI said two Bartlett officers opened fire on Bailey after he raised his weapon in the direction of the officers. A third officer also fatally wounded a dog inside the home.

The TBI arrived on the scene by 4 a.m. They confirmed they are investigating this case as an officer-involved shooting.
