(Memphis) Attorneys for a group hoping to save the historic Nineteenth Century Club on Union Avenue were in court again today, asking a judge to freeze money received in the sale of the club to the Union Group LLC.
“The courts talked about taking the sale proceeds, the money from the sale, how we freeze that and put it in escrow until such time we can get to the merits of the case,” said attorney Steve Mulroy, who is representing those trying to save the building.
The building was purchased by the Union Group LLL for $550,000.
Mulroy said the sale violated state law, because only Nineteenth Century Club board members approved the sale.
“The state law makes it absolutely clear that sale had to be approved by a vote of the full membership therefore the sale is void,” said Mulroy. That will be up to a judge to decide.
Now state representative Joe Towns is asking the Tennessee Attorney General to void the sale. The AG is already looking into the sale.
“Asking that the make sure that it was done in correct compliance with Tennessee law,” said Towns.
Now the group hoping to save the club needs the help of the community.
“If we don’t have the $50,000 injunction bond money by the close of business Monday, the injunction is lifted and demolition can continue,” said Mulroy.
