MEMPHIS, Tenn. — Even now that the 800-page TBI Report on Darrius Stewart’s shooting has been released, Shelby County District Attorney Amy Weirich is still not granting interviews on what made her seek an indictment in this case. Her office says it’s all in the report.
From witness statements to new video showing the struggle between Officer Connor Schilling and Darrius Stewart, the TBI looked at it all.
For the first time we are also seeing pictures of Schilling shortly after the fight that led to Stewart’s death.
Schilling was photographed showing the injuries to his arm, face and leg after the fight.
It’s the same evidence the District Attorney’s Office saw too. D.A. Amy Weirich still isn’t talking about the findings.
Last month, after a grand jury didn’t indict Schilling, she spoke briefly about what led her to pursue charges.
“There wasn’t particularly one thing. It was the file, the info presented to us. It was all that compiled with the law,” Weirich said back in November.
We are told witness statements were taken into consideration.
Several people said they saw Schilling shoot Stewart as Stewart was running away. Still other witnesses said Stewart was on the ground and shot in the back.
Then there was the trajectory of the gun shots in the medical examiner’s report. The medical examiner told investigators while there was no indication Stewart was shot while lying on his back with the officer over him, he could have been shot while lying on his side with the officer at a higher height.
Also at issue, the fact Schilling did not give a statement to investigators. According to the TBI report, he declined to speak with the TBI and wanted to talk to Memphis Police first and his union attorney.
The TBI report says the D.A.’s Office received several emails stating that a witness had evidence that Stewart’s homicide was premeditated. The report said the D.A.’s Office forwarded that information to the TBI.
