HOLLY SPRINGS, Miss. — A Marshall County Grand Jury has indicted the man accused of driving drunk and hitting a vehicle that was carrying a group of Briarcrest students.
Melandus Penson was charged with 5 counts of aggravated DUI.
Two of those students inside, 17-year-olds Rachel Lynch and Maddie Kruse, died as a result of that crash.
On June 10, the judge revoked Penson’s bond after the state submitted a motion to deny it saying Penson was a danger to the community.
The prosecutor even said Penson operating a vehicle was like giving him a deadly weapon.
They called Mississippi Highway Patrol Trooper Leo Hampton the stand.
Hampton told the courtroom Penson’s blood alcohol count was .14 at the time, almost twice the legal limit.
Penson told officers he was coming home from Arkansas, but also made a stop in Memphis.
