(Washington, DC) The U.S. Department of Education announced its Office for Civil Rights has reached a resolution agreement with Memphis City Schools on aids and services to students with disabilities.
A compliance review by the department addressed the district’s evaluations of students with food allergies, asthma, diabetes and other health issues that have individual health care plans to determine if the students qualify as a student with a disability under the law.
Under the agreement, MCS will contact parents or guardians of all students to let them know of the district’s obligation to evaluate students who are believed to need special education or related services due to a disability.
MCS will contact all parents in fall registration explaining the district’s obligation to evaluate students with health-related concerns.
Also, all MCS personnel will be trained in the identification, evaluation and placement of students with disabilities.
