MEMPHIS, Tenn. — Memphis Police say that a man fired shots at a victim twice on the same day after the two got into a fight about unfinished car repairs.

On Friday, officers responded to a shooting in the 500 block of E. Mallory. The victim told officers that a man, later identified as 64-year-old Daniel Tunstall, attempted to shoot him.

The victim said he was working on Tunstall’s car and Tunstall became upset due to the repairs not being completed. According to the victim, Tunstall came to the residence at 4:30 a.m. and an argument ensued, during which Tunstall allegedly fired shots at him.

The victim did not contact the police after the initial incident.

The victim said that Tunstall returned to the residence at 6:30 a.m. and allegedly fired a shot at him while he was asleep on the porch. He said that the gunshot woke him up and another physical altercation ensued between them.

During the fight, Tunstall allegedly continued to fire shots at the victim. The victim was not injured.

Tunstall dropped his wallet at the scene. Officers found three spent shell casings at the scene as well.

Officers proceeded to a residence in the 600 block of E. Davant to locate Tunstall. Upon approaching the residence, they noticed the door open, with Tunstall sitting on the couch and a black revolver on the table. He was arrested at the scene.

Investigators from the Violent Crimes Unit spoke with a witness who said he saw Tunstall shooting at the victim. He was able to kick the gun out of Tunstall’s hand and separate the men.

After breaking up the fight, the witness said Tunstall retrieved his handgun and left the scene. Both the victim and the witness described the handgun as a black revolver.

Investigators presented them with a six-person photographic lineup and they both identified Tunstall as the individual responsible for attempting to shoot the victim.

Investigators executed a search warrant at the residence on E. Davant, where they recovered a black .38 caliber Smith and Wesson firearm.

Tunstall has been charged with aggravated assault.
