Former MPD Officer Indicted For Official Misconduct

(Memphis) A former Memphis police officer accused of forcing a man to have sex in exchange for not taking him to jail has been indicted.

Brandon Berry was indicted by a grand jury this week for official misconduct. He turned himself into jail Thursday morning.

A victim of former MPD Officer Brandon Berry talked to News Channel 3 in May.

“I’ve got to go through this every day of my life,” the man, who asked to remain anonymous, said. “He made me perform some sexual acts.”

He told us that on January 18th that Berry pulled him over.

“He was telling me, `You know you have a warrant,'” the man said.

He claims that since he was a fugitive, he became Berry’s target.

He said the officer put him in his patrol car, but didn’t take him to jail.

Instead, the man said Berry drove him to an alley and forced him to perform oral sex on him.

“I did it for a second, but said ‘I can’t do this man. This ain’t me. I don’t feeling this man,’” he said. “He just sat there and just masturbated himself in the police car and I thought `Man! This is crazy! I can`t believe this is actually happening.'”

He said Berry then drove him back to his car.

Now, nearly six months later, a grand jury has indicted Berry for official misconduct.

The indictment alleges Berry unlawfully and knowingly refrained from performing his duty as a Memphis Police officer “with the intent to obtain a benefit.”

We tried to get Berry’s side to the story, but he didn’t answer the door at his south Memphis home.

Berry faces up to six years behind bars if convicted. He is out of jail on a $5,000 bond.
