(Memphis) A deal could keep a man charged with running over and killing a Cordova father from spending many years in prison.
This morning, 19-year-old Samer Sakaan plead guilty to reckless vehicular homicide and agreed to a sentence of three years.
Reckless vehicular homicide carries a sentence of 3 to 6 years.
Sakaan’s attorney is asking for probation.
Sakaan was arrested in May of 2011 when he hit and killed 36-year-old William Marshall
on Walnut Bend Road in Cordova.
Police say Sakaan passed an SUV, before running off the road and hitting Marshall.
The father of two was checking his mail when it happened.
Police at the scene said Sakaan had slurred speech and glassy eyes.
Attorney Randy Songstad says his client was not drunk and this is right sentence, “This is a very, very sad case. A man died in this case, but this man, my client, did not intentionally do it and the state had very little (evidence). My man had been playing tennis that morning, so he was not impaired. It was simply a car wreck.”
Marshall’s fiance was in the courtroom today, but didn’t have any comment.
Sakaan also plead guilty to a misdemeanor charge of aggravated criminal trespassing in a separate case.
He will be sentenced on September 21.
