NASHVILLE, Tenn. — A new court date has been set for the two Vanderbilt football players accused of rape.
Brandon Vandenburg and Cory Batey were scheduled to be back in court on July 8 at 9 a.m. for a hearing.
It’s unclear what will be discussed at that time, but News Channel 5 in Nashville reported it would most likely be the date for their retrial.
On June 23, the judge declared a mistrial after a hearing at which the duo’s attorneys claimed the pair did not get a fair trial because the jury foreman, Todd Easter, failed to reveal he had been the victim of statutory rape.
The prosecutor tried to argue the juror didn’t see himself as a victim, nor did he try to persuade the jury’s opinion.
The judge, however, said Easter failed “to speak the truth” and, therefore, the motion was granted.
Both were released from custody at that time.
